- Represented the personal representative of a $100MM estate in a complex, multi-party dispute against out-of-state professionals over their respective compensation for rendering services for the benefit of the estate. Utilizing sophisticated E-discovery strategies, the personal representative established at trial that the invoices submitted were fabricated, thereby dramatically reducing their respective fee awards and saving the estate nearly $1MM.
- Represented marketing agency in a bet-the-case lawsuit against a former employee who appropriated trade secrets to set up a competing company while still working for his employer. After taking forensic images of defendant’s phone and laptop, it was discovered that the defendant was communicating with the employer’s IT Manager during the course of litigation and receiving attorney-client privileged communications. After filing an emergency petition for extraordinary relief, the court struck the defendant’s pleadings as a sanction for its bad faith conduct.
- Represented high profile musician against claims brought by the estate of a former band member for alleged unpaid royalties.
- Represented real estate developer and condominium association against claims brought by former business partner for breach of fiduciary duty and other statutory claims in connection with operation of timeshare business.
- Represented financial institution serving as co-trustee against claims brought by guardian of the trust beneficiary for breach of trust and breach of fiduciary duty. All claims were favorably settled after conducting targeted discovery.
- Defended New York State Department of Health in an administrative proceeding brought by a pediatrician seeking injunctive relief in connection with a pending investigation for professional misconduct. The physician’s action was dismissed with prejudice, which was affirmed on appeal, thereby setting a very favorable precedent for the Department.
