Renowned Litigators Edward H. Zebersky and Mark Fistos Join Berger Singerman, Marking Expansion of the Firm’s Dispute Resolution Team

Berger Singerman, Florida’s business law firm, is pleased to announce the arrival of distinguished trial lawyers Edward H. Zebersky and Mark Fistos. The duo brings decades of experience in high-stakes, bet-the-company, and complex civil litigation, further strengthening the firm’s team of accomplished litigators. Zebersky, co-founder of the nationally recognized litigation boutique Zebersky Payne, LLP, joins Berger Singerman after establishing a remarkable reputation in high-profile matters.

Over the course of his career, Zebersky has handled more than 70 class actions and complex litigation matters, securing verdicts and settlements totaling over $400 million. His practice covers business torts, partnership disputes, securities and stockholder litigation, insurance coverage and bad faith claims, corporate fraud, product liability, RICO, and constitutional challenges. His experience also includes handling cases on behalf of businesses against their insurers for failure to defend against liability claims, as well as payment of business interruption, cargo, and credit insurance claims. He has held leadership roles in prominent legal organizations, including the Florida Justice Association and the American Association for Justice, where he continues to serve on several national committees. Zebersky is also a member of the American Board of Trial Advocates, the International Society of Barristers, and a Fellow of the International Academy of Trial Lawyers.
Under Zebersky’s leadership, Zebersky Payne, LLP garnered national attention and accolades from top legal directories and publications including U.S. News & World Report, Wall Street Journal, Florida Trend, and The Daily Business Review. Most recently, the firm was recognized in the 2025 Chambers Florida Spotlight Guide for its exceptional Commercial Litigation practice in Fort Lauderdale.
Mark Fistos also joins Berger Singerman alongside Zebersky, bringing more than two decades of experience in complex class action and consumer protection litigation. A former Assistant Attorney General in the Florida Attorney General’s Economic Crimes Unit, Fistos has prosecuted and litigated major consumer fraud, RICO, and privacy cases, including national class actions involving data privacy, long-term care insurance, and deceptive trade practices. His work has secured hundreds of millions of dollars in relief for consumers and meaningful injunctive relief against corporate misconduct.

Zebersky earned his law degree from the University of Miami School of Law, earning membership in the Order of the Coif. He holds dual degrees in Finance and Marketing from the University of Wisconsin–Madison. Fistos received both his M.A. and J.D. from Florida State University and continues to publish and speak frequently on consumer protection, privacy, and e-discovery topics.
