Mark Fistos is Of Counsel and part of the firm's Dispute Resolution Team. He focuses his practice on complex civil litigation in state and federal courts, with an emphasis on class actions and consumer protection law. He has more than 30 years of experience litigating high-impact cases involving false advertising, privacy violations, long-term care insurance disputes, unfair trade practices, and Qui Tam (whistleblower) claims.
Mark began his legal career as an Assistant Attorney General in Florida’s Economic Crimes Litigation Unit, where he prosecuted major consumer fraud and RICO cases. He was a primary drafter of the 1993 amendments to the Florida Deceptive and Unfair Trade Practices Act and continues to be a leading voice on consumer fraud, insurance law, and e-discovery issues.
Throughout his career, Mark has secured landmark settlements and injunctive relief for consumers nationwide. His representative matters include a $144 million nationwide settlement with a global computer manufacturer and a class settlement benefiting over 200 million Americans related to alleged privacy violations. In another matter, he helped secure an $8 million fund for elderly victims in a long-term care insurance class action and a $100,000 charitable donation to the Alzheimer’s Association.
